User Agreement
Terms of Service
Dear Client, welcome to register and become a client of the “CESC APP”. Before registration, please carefully read this registration agreement. Whether you have actually read this agreement or not, by selecting "Agree with the above" and clicking the "Login or Register" button, you are deemed to have agreed to and signed this service agreement.
1. General Rules
1.1 “CESC APP” is a PV/Inverter/Battery remote monitoring system provided by CESC New Energy Co., Ltd. (hereinafter referred to as "CESC").
1.2 All ownership, interpretation, and operation rights of “CESC APP” are owned and covered by CESC.
1.3 This agreement will be updated from time to time by CESC. Clients should read and agree to the updates immediately. CESC does not bear the obligation to notify. Such notices, announcements, statements, or similar content on CESC's website shall be deemed as part of this agreement. If a client disagrees with the amendments to relevant articles of this agreement by CESC, the client has the right to suspend using “CESC APP”. If a client continues using “CESC APP”, it is deemed that the client has accepted the amendments to relevant articles of this agreement.
2. Attentions
2.1 After completing registration, you should keep all account numbers and passwords confidential and not disclose them to any unauthorized third party. Any loss or damage arising from a client's failure to properly keep its account number or passwords shall not be covered or borne by CESC.
2.2 If necessary, CESC has the right to check relevant information of a client. With the client's consent, CESC may alter and change relevant configurations or information related to PV products.
3. Use Rules
3.1 Clients shall strictly comply with the management and use rules of “CESC APP”.
3.2 Clients shall comply with relevant laws and regulations, shall not upload any illegal information, and shall not infringe any patent right, copyright, trademark right, reputation right, or legitimate interest of any third party. In case of violation, clients shall independently cover and bear all liabilities.
3.3 Clients shall carefully keep their “CESC APP” account numbers and passwords. All losses arising from improper management and use of account numbers and passwords, including all losses arising from improper use by the client, its authorized third party, or its unauthorized third party, shall be independently covered and borne by the client. If a client finds that its account is used by an unauthorized third party or its account information is disclosed, it shall immediately modify the passwords and notify us.
3.4 Clients shall provide relevant information to “CESC APP” truthfully, including email addresses, product serial numbers, etc. Clients shall independently cover and bear all liabilities arising from incorrect or inaccurate information.
4. Privacy Protection
4.1 CESC will not publicize or provide any third party with individual clients' registration information and non-public content when using “CESC APP”, except in the following circumstances:
- (1) CESC obtains the client's prior express authorization;
- (2) CESC is required by relevant laws and regulations;
- (3) CESC is required by competent government departments;
- (4) CESC is to safeguard public interests;
- (5) CESC is to improve the service quality of “CESC APP”.
4.2 CESC may cooperate with third parties in providing relevant network services to clients. In such cases, if the third party agrees to equally cover and bear client privacy protection responsibilities, then CESC has the right to provide the third party with clients' registration information.
4.3 Under the precondition that individual clients' private information is not disclosed, CESC has the right to analyze the entire client database and commercially use such database.
5. Disclaimer
5.1 CESC will make all efforts to ensure the accuracy and completeness of the information in “CESC APP”. In case of information or data errors arising from a client's violation of the use rules, CESC shall cover no liability.
5.2 If network service suspension or other defects arise from force majeure or reasons beyond CESC's control, CESC shall cover no liability but will make all efforts to reduce the client's loss and effect arising therefrom.
5.3 If necessary, CESC may check relevant information of the client's PV products. With the client's consent, CESC may modify and adjust the relevant configurations of the PV products.
5.4 CESC shall cover and bear no liability in case of quality problems and any loss arising from the following products or services provided to a client:
- (1) Any product or service that CESC presents to a client;
- (2) Such products or services that CESC provides (free of charge) to a client.
5.5 If a client violates the use rules or relevant laws or regulations, CESC has the right to stop and suspend the service, whether notified or not. In such cases, CESC shall cover and bear no liability against the client or any third party.
5.6 With respect to clients who intentionally damage the “CESC APP” system and use the system to cause loss to third parties, CESC reserves the right to prosecute. Expenses arising therefrom, including but not limited to lawsuit fees, lawyer's fees, investigation fees, and travel expenses, shall be fully covered by the client.
Privacy Policy
This privacy statement explains CESC's privacy practices for users of the websites, including the CESC monitoring platform and APP (collectively referred to as the “Site”).
Account Information
Except as otherwise set forth herein, we will keep confidential any Private Information related to your account with us.
What is Personal Information?
Personal Information is information that can be directly associated with an identifiable natural person such as a customer’s name, address, telephone number, email address.
Collection of Personal Information
We collect Personal Information that you provide us, such as when you:
- Register to use the Site or to receive our newsletter;
- Register to use the CESC Monitoring Platform or APP;
- Use the administrative interface of the CESC Monitoring Platform or APP to provide information related to your PV/Inverter/Battery system and account;
- Contact our customer support whether by phone, email, or chat.
When you visit our site, we may automatically collect some information, such as the site from which you linked to us, the time and date of your visit, purchases, and activities. We also collect information received from third parties to the extent that they have represented that they have entered into an agreement with you for the connectivity of CESC products to our monitoring platform and APP. CESC does not knowingly collect Personal Information from children under the age of 16, and you must be at least 17 years old to establish an account on the Site.
Use of Personal Information
The Personal Information we collect is used to process your requests or transactions, provide you high-quality service, customize the site according to your preferences, and inform you about specific goods or services we believe will be of interest to you. If you prefer not to receive promotional information from us, we make it easy for you to let us know. You can contact us at any time to decline promotional information (see the “Choice” section below).
Sharing of Personal Information
CESC does not sell or rent Personal Information to third parties without your prior consent. CESC does not share or disclose Personal Information to third parties without your prior consent, except in the limited circumstances described below under the “Disclosures” section.
Disclosures
We may disclose Personal Information in the good faith belief that we are required to do so by law, or that doing so is reasonably necessary to comply with legal process or contractual necessity, respond to any claims, or protect the rights, property, or personal safety of CESC, our customers, or the public. Information about our customers, including Personal Information, may be disclosed if it is necessary for legitimate purposes, such as part of, or during negotiations of, any merger, sale of company assets, or acquisition. Other than in the circumstances enumerated above, we have a policy of obtaining a person’s consent if we intend to process his/her Personal Information.
Protection of Personal Information
CESC has put security measures in place in an effort to protect Personal Information from loss, misuse, or alteration while it is under our control. Personal Information we collect is stored electronically. We use technical, contractual, administrative, and physical measures in an effort to protect against unauthorized access.
Account information is accessible online only through the use of a password. To protect the confidentiality of Personal Information, you must keep your password confidential and not disclose it to any other person. If other people have access to your email, they may be able to obtain access to your password and obtain Personal Information about you or change information about your user profile.
While we use reasonable measures to protect information stored within our database, and we restrict access to information to those employees who need access to perform their job functions, such as our customer service personnel and technical staff, we cannot guarantee the security of account information. Unauthorized entry or use, hardware or software failure, and other factors may compromise the security of account information at any time. We cannot ensure the security of the information you transmit to us, so we urge you to take every precaution to protect your Personal Information when you are on the Internet. Change your passwords often, use a combination of letters and numbers, and make sure you use a secure browser.
Aggregate Information
Personal information does not include “aggregate” information. Aggregate information is data we collect about a group or category of products, services, or customers, from which individual customer identities have been removed, and a specific person cannot be identified through such information. Aggregate information is also any information or data we collect from inverters and power optimizers, which are available to you via the CESC monitoring platform or APP. In other words, information about how you use a service may be collected and combined with information about how others use the same service, but no Personal Information will be included in the resulting data.
